Terms of Service

Please read these Terms of Service carefully before using VibeForge. These Terms constitute a legally binding agreement between you and VibeForge regarding your use of our platform and services.

1. Acceptance of Terms

By accessing or using VibeForge ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Description of Service

VibeForge is a browser-based Shopify theme development studio that uses artificial intelligence to help you build, edit, and deploy Shopify themes. The Service includes a cloud code editor, AI-assisted code generation, store cloning tools, version history, and Shopify theme publishing capabilities.

3. Accounts and Registration

You must create an account to use most features. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 18 years old and provide accurate, complete information. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Shopify Store Connection

The Service may connect to your Shopify store via OAuth to read and write theme files on your behalf. You grant VibeForge permission to access your store's themes as authorized during the OAuth flow. You remain solely responsible for all content published to your store. VibeForge does not store your Shopify admin API credentials beyond what is required for authenticated sessions.

5. AI-Generated Content

The Service uses third-party AI models (including but not limited to Anthropic Claude, OpenAI, Google Gemini, and others) to generate Shopify Liquid code and design assets. AI-generated output may be imperfect, incomplete, or require human review before deployment. You are solely responsible for reviewing, testing, and approving any AI-generated content before publishing it to a live store. VibeForge makes no guarantees about the accuracy, fitness, or Shopify compatibility of AI-generated output.

6. API Keys and Third-Party Services

You may provide API keys for third-party AI providers to enable certain features. These keys are encrypted at rest using AES-256-GCM encryption. VibeForge does not use your keys for any purpose other than making requests on your behalf within the Service. You are responsible for the usage and costs incurred through your own API keys on third-party platforms.

7. Billing and Subscriptions

Certain features require a paid subscription. Billing is handled by Stripe. By subscribing, you authorize us to charge the applicable fees to your payment method on a recurring basis. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are offered at our discretion within 7 days of initial purchase. Plan limits (projects, stores, AI requests) are enforced as described on the Pricing page and are subject to change with notice.

8. Acceptable Use

You agree not to: (a) use the Service to infringe intellectual property rights of others; (b) clone or replicate a competitor's store in violation of their terms; (c) copy brand assets, logos, trademarks, or proprietary images from scraped stores; (d) use the Service to generate malicious code or conduct attacks; (e) attempt to reverse-engineer, scrape, or abuse the platform infrastructure; (f) resell or sublicense access to the Service without our written consent.

9. Intellectual Property

VibeForge retains all rights to the platform, its code, design, and branding. Theme code you generate and publish using the Service is yours. You grant VibeForge a limited license to store and process your project files solely to provide the Service. The VibeForge name, logo, and product design are trademarks of VibeForge and may not be used without permission.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of data as described in the Privacy Policy.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. VIBEFORGE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED THEMES WILL FUNCTION AS EXPECTED ON YOUR SHOPIFY STORE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBEFORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. You may terminate your account at any time from the Settings page. Upon termination, your project data will be retained for 30 days before deletion, unless you request immediate deletion.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes via email or in-app notice. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Quebec, Canada.
